It's not the teen who's gay, it's his sister, who's already been deported. This guy missed a number of immigration hearings and didn't tell them when he moved - he's being slippery. Send him back. If we keep him we might as well just open the doors and put out the welcome mat.
But the gay thing carries a lot of weight these days. Punch a gay guy spend 6 years in jail, punch a straight guy and get maybe 6 months or less. The Globe and Mail just breathlessly reported that some gay newspaper boxes were vandalized in Vancouver. Wonder how many Globe and Mail boxes have been vandalized over the years, and they never thought it important enough to tell me about it.
I don't understand what he is doing here anyway? He is just as illegal as anyone else without the proper paperwork. So was his sister. They claim her gf was murdered because she was gay but who says that is true, and even if it is, would that mean Canada should give refugee status to all gay Mexicans and their families?

I think you might be simplifying the whole hate crime sentencing provisions. The purpose of the sentencing provisions was to have Canada recognize that while punching somebody out of anger is bad, punching somebody out of hate for their identity sends a chill out to others who are also of that identity.
It doesn't necessarily mean that "punch a gay guy spend 6 years in jail" is going to happen just because the victim is gay. But, if the assaulter spent time tracking the victim over a series of weeks because the victim kissed another man at a train station goodbye, lured him into an alleyway and then proceeded to yell about the wrath of God being brought down on sinners before smashing in his teeth with one solid blow, don't you think that might be a bit more deserving of jail time than a guy who punches another guy for staring at his girl at the bar?
Each example ends with a pop in the mouth, but one is a much more sinister crime. Also, a Judge is free to hand down sentences as he sees fit given the particular circumstances of each crime. Hate crime sentencing provisions provide for a Judge to increase sentence length, not a .
Cool, if his trick will work, everyone from Mexico will say that they're gays and move to Canada and after a 50 years the maple leaf on flag can be painted in pink .
Oh man, is this ever a load of bullshit. He moved here 3 years his sister's g/f was "murdered". And we have an organization called "No One is Illegal"???
What's really pathetic about all this is the amount of support he's being given. Seems that immigration lawyers and others are just too willing to take people's words without ANY trace of evidence to back the claim up.

Apparently the Judge in the case didn't buy his claim either. Looks like they'll be a free spot in grade 11 classes on Monday.
The worst part about these sorts of claims is that it makes it harder for legitimate refugees to have their claims taken seriously without the average Canadian immediately suspecting some sort of immigration fraud.
Canada's immigration courts should be havens for legitimate refuge, not open-mike comedy clubs looking for "Bestest Excuse Everz!! Lolz"
